WEBSITE DATA, COMPILATION ARCHIVAL DATA, COPYRIGHT, AND PUBLIC EDUCATIONAL USE

All website data, inclusive of all compilation archival data, notices, articles, videos, graphics, photographs and images, are the sole property of Public Art in Public Places Project and are copyright protected against unauthorized use. Commercial uses are prohibited; educational non-commercial uses may be allowed with restrictions. Notwithstanding, written permission from the Director is required of any and all website data use.


I. Specific Terms of Use: Public Art in Public Places [www.publicartinpublicplaces.info]

Your use of the web site www.PublicArtinPublicPlaces.info and its contents, including descriptive, digital photographic and video data, and including all “Compilation Archival Materials and Data”, is subject to these Specific Terms of Use (“Specific Terms”). As used in these Specific Terms, “Public Art in Public Places” means Public Art in Public Places Project, a California-based not-for-profit arts organization, whose principal place of business is at 353 West Seventh street, Claremont, California, United States; and “you”, including all of its grammatical forms, refers to the person using this website and, if that person is acting on behalf of another person or entity, it also refers to and includes that person or entity.(1) NO PERMISSION GRANTED FOR COMMERCIAL USE: Notwithstanding any other provision of these Specific Terms, no permission or license is granted by these Specific Terms to any person to download, copy, transmit, publish, or display or otherwise use any Compilation Archival Materials for: (a) compilation use by commercial stock houses or use by any commercial, non-profit, governmental, or any other archive, (b) use by any person, other than non-profit and governmental entities as set forth in other sections of these Specific Terms, in providing instructional or educational materials to educators, teachers, schools, universities, students or the general public, or (c) the purpose of creating derivative works.(2) REQUESTING PERMISSION: If your proposed use of Public Art in Public Places’ Compilation Archival Materials and Data does not meet these stated conditions for Fair Use, Educational Use, or Press Use, you must request and obtain express permission from Public Art in Public Places for use of its Compilation Archival Materials. Contact information is published on the Web Site under “Contact.”(3) POSSIBLE ERRORS, OMISSIONS: Public Art in Public Places strives for the highest accuracy and quality of its Compilation Archival Data, applying extensive fact-checking and on-site verification. These efforts support a high degree of accuracy, but Public Art in Public Places can not and does not guarantee complete or absolute accuracy. (4) CHANGES/MODIFICATION OF TERMS: Public Art in Public Places reserves the right at any time without any notice to any person to change or modify these Specific Terms and to change, modify, cease publication of or terminate the Service, or any aspect or portion of it. All rights in or to the use of these Compilation Archival Materials, not expressly granted to any person by Public Art in Public Places, are retained by Public Art in Public Places.

II. Copyright and Other Rights

Public Art in Public Places owns and expressly reserves all rights, including copyright, in whole and in part, throughout the world, in the archival materials and compilations contained on the website www.publicartinpublicplaces.info. All website contents, including images, text, audio, video, illustrations, designs, documentation, and other data (including “Compilation Archival Data”) are protected by copyright. (1) RESERVATION OF LEGAL REMEDIES: Public Art in Public Places expressly reserves all remedies available under all applicable laws, regulations and statutes with respect to these data and archival materials (“Compilation Archival Materials and Data”).(2) NO CLAIM OF ARTWORK RIGHTS: Public Art in Public Places does not claim ownership of copyright pertaining to any actual and original works of public art, otherwise held by third parties, that are depicted in the public art archival compilation data.

III. Limited Right to Use Compilation Archival Materials

Public Art in Public Places grants you the right to use its Compilation Archival Materials and Data to display, download, and copy, solely for your own limited non-commercial, personal, and educational, research, or scholarly use, and subject to any further requirements, restrictions or limitations published with respect to any specific archival materials, with the following basic restrictions:(1) CITATIONS: All copies of the Compilation Archival Materials and Data must be properly cited and bear accurate identifying information, including proprietary information, credits, and/or attributions; copyright and trademark notices/images; and citation to the URL address of their source webpage.(2) COMMERCIAL USE EXPRESSLY PROHIBITED: You may not copy, distribute, publish, publicly perform, publicly display, modify, transmit, reuse, download, repost, or use these Compilation Archival Materials and Data for commercial purposes, for personal gain, or to create or generate derivative works, without the express prior written permission of Public Art in Public Places, with the following limited exceptions: (a) Fair Use or another legislative exemption, (b) Permitted Educational Use, or (c) Press Use, as described below.

IV. Fair Use and Permitted Educational Use

Unless otherwise noted, no express permission is required from Public Art in Public Places for any use that falls within “Fair Use”, “Educational Use,” or another legislative exemption under the U.S. Copyright Act. Under “Fair Use” and/or “Educational Uses”, your reproduction, distribution, display, transmission, and use of these Compilation Archival Materials and Data must be done in accordance with 17 U.S.C. §107 (“Fair Use”), 17 U.S.C. §110 (the Teach Act), or other applicable exemptions set forth in the U.S. Copyright Act and related laws, with the following two requirements:(1) No modifications may be made as to the integrity or attribution of the Compilation Archival Materials and Data.(2) All copies of the Compilation Archival Materials and Data must be properly cited and bear accurate identifying information as published on the Public Art in Public Places web site,(a) including credits and copyright notices,(b) including a citation to Public Art in Public Places, as a not-for-profit arts organization, and(c) including the URL address from which the Compilation Archival Materials were obtained.

IV. Press Use

Public Art in Public Places may provide material on its Web Site for members of the press, for use in timely news publications. Except where noted otherwise, photographs, images, and articles that appear on the publicartinpublicplaces.info Web Site may be downloaded, copied, and published (and in the case of text-based materials, translated) by members of the press for the sole purpose of creating or supporting timely news stories related to Public Art in Public Places and its online database of Compilation Archival Materials, to be published in newspapers, magazines, Web publications, television, or other paper, broadcast and electronic media. These Materials may not be downloaded, reproduced, or published by commercial stock houses or commercial or non-profit archives under any circumstances. (1) Use may not compromise the original context, accuracy, and integrity of the data. (2) Photographs and other images must be reproduced in their entirety and not cropped or otherwise altered.(3) Use must include the identifying information provided by Public Art in Public Places, including proprietary collection information, artist and/or other credit data, and the Public Art in Public Places copyright notice.
